Common questions we get asked

Civil litigation in NSW covers a broad range of disputes, from breach of contract to debt recovery and negligence. There are many misunderstandings surrounding the litigation process which can be confusing, so to assist, we have provided some general answers below to several of the most common queries our team of civil litigation lawyers are asked.

As each dispute is individual, the below information is provided only as an assistance to understand some of the aspects regarding civil litigation, and cannot be considered as legal advice.

Civil litigation is a legal dispute between two or more parties (individuals or businesses) seeking money damages or specific performance, rather than criminal sanctions. Common cases include breach of contract, debt recovery, and property disputes.

No. In fact, the vast majority of civil disputes are resolved out of court. We utilise Alternative Dispute Resolution (ADR) methods, such as mediation and negotiation, to settle your matter quickly and save you significant legal costs.

Under the Limitation Act 1969 (NSW), the general time limit to commence civil proceedings for a breach of contract or an action in tort (like negligence) is 6 years from the date the cause of action occurred.

If you are served with a Statement of Claim and fail to file a formal defense within 28 days, the other party can apply for a “default judgment” against you. This means they win the case automatically and can begin enforcing the debt.

Generally, the successful party in a civil litigation matter will be awarded a “costs order” by the Court. This requires the unsuccessful party to pay a significant portion (usually 60% to 70%) of the winning party’s legal fees.

A Letter of Demand is a formal letter sent by our lawyers to the opposing party, outlining your legal claim and demanding a specific action (usually payment) within a set timeframe before court proceedings are initiated.

We represent clients across all relevant jurisdictions in New South Wales, including the Local Court, the District Court, the Supreme Court of NSW, and the Federal Court of Australia, depending on the monetary value and complexity of your claim.
